تنبيه — اقرأ بعناية. هذه الاتفاقيّة عقدٌ قانونيّ بينك (فرداً أو كياناً تجاريّاً واحداً، «المُرخَّص له») وبين ScrjamSoft («المُرخِّص»). بتنصيبك البرمجيّة أو تفعيلها أو استعمالها بأيّ وجه، فإنّك توافق على الالتزام بهذه الاتفاقيّة. وإن لم توافق، فلا تُنصِّب البرمجيّة ولا تستعملها، ولك أن تطلب استرداداً خلال سبعة (7) أيّامٍ من شرائك. IMPORTANT — READ CAREFULLY. This Agreement is a legal contract between you (an individual or a single business entity, the "Licensee") and ScrjamSoft (the "Licensor"). By installing, activating, or using the Software in any way, you agree to be bound by this Agreement. If you do not agree, do not install or use the Software, and you may request a refund within seven (7) days of your purchase.
١. التعريفات1. Definitions
«البرمجيّة» تعني برامج PrimeCafe (الخادم، إدارة سطح المكتب، وكيل الجهاز، تطبيق الهاتف، المثبّتات، والتحديثات). «النسخة» تعني الفئة التجاريّة للترخيص وتحدّد المزايا وحدود الأجهزة. «الترخيص» مفتاحٌ يفعّل تنصيباً واحداً. «التنصيب» نشرٌ واحدٌ مربوطٌ بجهازٍ مضيف داخل موقعٍ ماديّ واحد. «التجربة» ترخيصٌ محدود المدّة (سبعة أيّام عادةً) للتقييم. "Software" means the PrimeCafe programs (server, desktop administration, PC agent, mobile app, installers, and updates). "Edition" means the commercial tier of a License and determines features and device limits. "License" is a key that activates one Installation. "Installation" is a single deployment bound to one host machine within one physical venue. "Trial" is a time-limited License (typically 7 days) for evaluation.
٢. منح الترخيص2. Grant of License
رهناً بالتزامك المستمرّ بهذه الاتفاقيّة وسداد الرسوم، يمنحك المُرخِّص ترخيصاً غير حصريّ، وغير قابل للنقل، ولا للترخيص من الباطن، وقابلاً للإلغاء، لتنصيب البرمجيّة واستعمالها في تشغيل عملك الداخليّ لموقعٍ واحد، في حدود النسخة وسقوفها. تفرض كلّ نسخةٍ حدوداً قصوى لعدد أجهزة الحاسوب ومحطّات PlayStation وأجهزة الإدارة عبر الهاتف؛ ولا يجوز تجاوزها. ترخيص التجربة «كما هو» للتقييم فقط، ويقتصر على تجربةٍ واحدة لكلّ نشاطٍ ولكلّ جهاز. وكلّ الحقوق غير الممنوحة صراحةً محفوظةٌ للمُرخِّص؛ فالاتفاقيّة تُرخِّص البرمجيّة ولا تبيعها. Subject to your continuous compliance and payment of fees, the Licensor grants you a non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Software for your own internal operation of a single venue, within the Edition's limits. Each Edition enforces maximum counts of PCs, PlayStation stations, and mobile devices, which you may not exceed. A Trial is provided "as is" for evaluation only and is limited to one Trial per business and per machine. All rights not expressly granted are reserved; this Agreement licenses, and does not sell, the Software.
٣. القيود3. Restrictions
لا يجوز لك ولا أن تسمح لطرفٍ ثالث بأن:You shall not, and shall not permit any third party to:
- تنسخ البرمجيّة أو توزّعها أو تعيد بيعها أو تؤجّرها أو تستضيفها كخدمة خارج موقعك المرخَّص الواحد؛copy, distribute, resell, rent, or host the Software as a service beyond your single licensed venue;
- تعكس هندستها أو تفكّ تصريفها أو تستخلص شيفرتها أو خوارزمياتها، إلّا بالقدر الذي يجيزه القانون صراحةً؛reverse engineer, decompile, or derive its source code or algorithms, except to the limited extent the law expressly permits;
- تعدّلها أو تشتقّ منها أعمالاً، أو تزيل إشعارات الملكيّة؛modify it or create derivative works, or remove proprietary notices;
- تتجاوز أو تعطّل تفعيل الترخيص أو ربطه بالعتاد أو فحوص السلامة، أو تستعمل مفتاحاً غير صادرٍ لك؛circumvent or tamper with license activation, hardware binding, or integrity checks, or use a key not issued to you;
- تشغّل أجهزة أو مواقع أكثر ممّا يجيزه ترخيصك، أو تتشارك ترخيصاً عبر مواقع متعدّدة، أو تستعملها بأيّ وجهٍ غير مشروع.run more devices or venues than your License permits, share one License across venues, or use it unlawfully.
٤. الملكيّة الفكريّة4. Intellectual Property
البرمجيّة مُرخَّصة لا مَبيعة، ويحتفظ المُرخِّص بكامل حقوقها وملكيّتها الفكريّة. أمّا بياناتك — سجلّات الزبائن والجلسات والمعاملات — فتبقى ملكاً لك، ولا تمنح هذه الاتفاقيّة المُرخِّص أيّ ملكيّةٍ لبياناتك. The Software is licensed, not sold; the Licensor retains all rights and intellectual property in it. Your data — customer records, sessions, and transactions — remains yours, and this Agreement grants the Licensor no ownership of it.
٥. التفعيل وتحقّق الترخيص5. Activation & License Validation
تستلزم البرمجيّة تفعيلاً بمفتاحٍ صالح وتربطه بالجهاز المضيف (بصمة عتادٍ ومُعرِّف تنصيب)، وتتحقّق دوريّاً من الترخيص عبر الإنترنت مع مدّة سماحٍ محدودة عند انقطاع الشبكة. وإذا انتهى الترخيص أو عُلِّق أو أُلغي أو استُعمل إخلالاً بالاتفاقيّة (بما فيه العبث أو إساءة استعمال التجربة)، جاز للبرمجيّة أن تقيّد وظائفها حتى استعادة ترخيصٍ صالح. The Software requires activation with a valid key, binds it to the host machine (a hardware fingerprint and an installation identifier), and periodically validates the License over the Internet with a limited offline grace period. If a License expires, is suspended, revoked, or used in breach (including tampering or trial abuse), the Software may restrict functionality until a valid License is restored.
٦. التحديثات والدعم والاسترداد6. Updates, Support & Refunds
قد يوفّر المُرخِّص تحديثاتٍ وإصدارات جديدة تخضع لهذه الاتفاقيّة. ويخوّلك الترخيص المدفوع استعمال البرمجيّة وتلقّي التحديثات طوال مدّة شرائك. الاسترداد: لك أن تطلب استرداداً خلال سبعة (7) أيّامٍ من شرائك؛ وبعدها تكون الرسوم غير قابلة للاسترداد إلّا حيثما يوجب القانون ردَّها. The Licensor may provide updates and new versions governed by this Agreement. A paid License entitles you to use the Software and receive updates for the period of your purchase. Refunds: you may request a refund within seven (7) days of your purchase; after that, fees are non-refundable except where required by applicable law.
٧. المدّة والإنهاء7. Term & Termination
الاتفاقيّة نافذةٌ إلى أن تُنهى، وتنتهي تلقائيّاً عند إخلالك بأيٍّ من بنودها، وللمُرخِّص إنهاؤها عند انتهاء الصلاحيّة أو عدم السداد أو إساءة الاستعمال. وعند الإنهاء عليك وقف كلّ استعمالٍ وإزالة التنصيبات. وتبقى سارية البنودُ التي تقتضي طبيعتُها البقاء (الملكيّة، إخلاء الضمان، حدّ المسؤوليّة، القانون الحاكم). This Agreement is effective until terminated; it terminates automatically on your breach, and the Licensor may terminate it on expiry, non-payment, or misuse. On termination you must cease use and remove installations. Sections that by nature should survive (ownership, warranty disclaimer, limitation of liability, governing law) survive termination.
٨. إخلاء الضمانات8. Disclaimer of Warranties
تُقدَّم البرمجيّة «كما هي» و«حسب توافرها»، دون أيّ ضمانٍ صريحٍ أو ضمنيّ، بما في ذلك ضمانات الرواج والملاءمة لغرضٍ معيّن وعدم الانتهاك. ولا يضمن المُرخِّص أن تكون بلا انقطاعٍ أو خطأ. وأنت المسؤول عن الاحتفاظ بنُسخٍ احتياطيّة لبياناتك. The Software is provided "as is" and "as available", without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. The Licensor does not warrant it will be uninterrupted or error-free. You are responsible for maintaining backups of your data.
٩. البيانات والخصوصيّة9. Data & Privacy
بيانات عملك تُخزَّن محليّاً على أنظمتك (وفي قاعدةٍ مشفّرة حيثما ينطبق)، ولا يجمع المُرخِّص بيانات زبائنك ولا معاملاتك عبر البرمجيّة. ولأغراض التفعيل والتحقّق فقط، تُرسِل البرمجيّة بياناتٍ تقنيّةً محدودة: مفتاح الترخيص، ومُعرِّف التنصيب، وبصمة عتادٍ مشتقّة، وحالة الترخيص. وأنت المسؤول عن الامتثال لقوانين البيانات الشخصيّة لزبائنك. راجِع سياسة الخصوصيّةour Privacy Policy. Your business data is stored locally on your systems (encrypted where applicable); the Licensor does not collect your customers' data or transactions through the Software. For activation and validation only, the Software sends limited technical data: the license key, an installation identifier, a derived hardware fingerprint, and license status. You are responsible for complying with personal-data laws regarding your customers. See our Privacy Policy.
١٠. حدّ المسؤوليّة10. Limitation of Liability
إلى أقصى حدٍّ يجيزه القانون، لا يكون المُرخِّص مسؤولاً عن أيّ أضرارٍ غير مباشرة أو عرضيّة أو تبعيّة، ولا عن خسارة الأرباح أو البيانات أو انقطاع العمل. ولا تتجاوز مسؤوليّته الإجماليّة المبلغَ الذي دفعتَه فعليّاً مقابل الترخيص خلال الاثني عشر (12) شهراً السابقة للحدث المُنشئ للمطالبة. To the maximum extent permitted by law, the Licensor shall not be liable for any indirect, incidental, or consequential damages, nor for lost profits, data, or business interruption. Its total aggregate liability shall not exceed the amount you actually paid for the License during the twelve (12) months preceding the event giving rise to the claim.
١١. مكوّنات الأطراف الثالثة11. Third-Party Components
تتضمّن البرمجيّة مكوّناتٍ مفتوحةَ المصدر مرخّصةً بشروطها الخاصّة، وتحكم تلك الشروطُ استعمالَك للمكوّنات المعنيّة. The Software includes open-source components licensed under their own terms, which govern your use of those components.
١٢. القانون الحاكم والنزاعات12. Governing Law & Disputes
تخضع هذه الاتفاقيّة لقوانين دولة فلسطين، دون اعتبارٍ لقواعد تنازع القوانين، وتختصّ المحاكم المختصّة في دولة فلسطين اختصاصاً حصريّاً بأيّ نزاعٍ ينشأ عنها، ما لم يقضِ قانونٌ آمر بغير ذلك. This Agreement is governed by the laws of the State of Palestine, without regard to conflict-of-law rules, and the competent courts of the State of Palestine shall have exclusive jurisdiction over any dispute, unless mandatory law provides otherwise.
١٣. أحكام عامّة13. General
هذه هي الاتفاقيّة الكاملة وتَجُبّ ما سبقها. وإذا قُضي بعدم نفاذ بندٍ بقيت سائر البنود نافذة. وعدم الإنفاذ لا يُعدّ تنازلاً. ولا يجوز لك إحالة الاتفاقيّة دون موافقةٍ خطّيّة. ويجوز للمُرخِّص نشرَ نسخٍ محدَّثة، والنسخة الرسميّة السارية متاحةٌ دوماً على scrjamsoft.com/legal/eula.html، ويُعدّ استمرارُ الاستعمال بعد التغيير قبولاً للنسخة المحدَّثة. This is the entire agreement and supersedes prior understandings. If a provision is held unenforceable, the rest remain in force. Failure to enforce is not a waiver. You may not assign this Agreement without written consent. The Licensor may publish updated versions; the current authoritative version is always at scrjamsoft.com/legal/eula.html, and continued use after a change constitutes acceptance.
